1. About Anew and these terms
Anew is an online marketplace that lets people buy and sell secondhand goods ("everything but clothes"). Anew is operated by [Operator legal name] ("Anew", "we"). These Terms form a binding agreement between you and Anew when you create an account or use the Service. Please also read our Privacy Policy and Cookie notice.
2. Accounts
You must be at least [16] years old and able to enter a contract. Provide accurate information, keep your credentials secure, and you are responsible for activity on your account. One person, one account, unless we agree otherwise.
3. How the marketplace works
Sellers list items; buyers can buy at the asking price or make an offer; sellers may accept, decline, counter or set a minimum. Buyers can reserve an item briefly, bundle several items from one seller, and pay into escrow. Ownership and risk pass on handover/delivery as agreed between the parties.
There are two kinds of seller: private individuals selling their own used goods, and professional sellers (traders acting for purposes relating to their trade, business or profession). Professional sellers are identified as such and are subject to Section 12.
4. Listing rules — prohibited & restricted items
You may only list items you own and are lawfully entitled to sell, described honestly. You may not list, among other things: counterfeit or IP-infringing goods; weapons, ammunition and regulated knives; drugs, medicines, tobacco and related products; live animals; hazardous or recalled products; stolen goods; adult or age-restricted material; food where prohibited; personal data or account credentials; and anything whose sale is illegal in the buyer's or seller's country. Clothing is out of scope by design. We may add category rules and remove listings that breach them.
5. Buying, buyer protection & protected pickup
When you buy, your payment is held in escrow by our payment provider and released to the seller only when the transaction is completed — for local deals, when the one-time handover code is entered at pickup; for shipped items, on delivery confirmation or after the applicable window. If an item is not as described, does not arrive, or the handover does not happen, you may open a dispute within [the stated window] and, where justified, be refunded in full or in part. This buyer-protection service is provided by Anew in addition to your legal rights and does not limit them.
6. Fees
Browsing and listing are free. A buyer-protection fee of [5% + €0.70] is added at checkout and paid by the buyer; it funds escrow, protection and support. Private sellers pay no selling fee (0%). Professional sellers pay a commission of [7%] on the sale price (Section 12). Optional paid features (e.g. "Boost") are priced in-app before you buy them. We donate 10% of buyer-protection fees to repair-and-reuse causes, as described on our pledge page. Fees are shown inclusive of VAT where applicable.
7. Right of withdrawal (distance selling)
If you buy from a professional seller as a consumer, you generally have the right to withdraw within 14 days under Directive 2011/83/EU, without giving a reason, subject to legal exceptions (for example sealed goods unsealed after delivery, or goods made to your specification). The professional seller must inform you how to exercise this right and bears the corresponding obligations.
8. Legal guarantee of conformity
Purchases from a professional seller benefit from the EU legal guarantee of conformity (Directive (EU) 2019/771), normally for at least two years. This is separate from any commercial warranty a seller may offer and from Anew's buyer protection.
9. Your content
You keep ownership of the photos and text you upload. You grant Anew a non-exclusive, royalty-free licence to host, display and reproduce that content as needed to operate and promote the Service. You are responsible for your content and confirm you have the rights to it.
10. Acceptable use
Don't use Anew to break the law, defraud or harass others, take deals off-platform to evade protection, scrape or overload the service, post malware, or misrepresent items. We may screen messages and listings for scams and prohibited content.
11. Illegal content, notices and complaints (Digital Services Act)
In line with the EU Digital Services Act, anyone may notify us of content or a listing they consider illegal by [using the in-app "Report" action or emailing dsa@shopanew.eu], giving enough detail to locate and assess it. We will act in a timely, diligent and non-arbitrary way, and where we remove or restrict content we will give the affected user a statement of reasons and access to our internal complaint-handling procedure. Where we become aware that an illegal product was offered, we will inform affected buyers as required by Article 32. We do not use "trusted flagger" priority except as the law requires.
12. Professional sellers
If you sell in the course of a trade, business, craft or profession, you must register as a professional seller and provide the information required by Article 30 of the Digital Services Act (name, address, contact details, payment account identifier, trade-register and self-certification), which we verify on a best-efforts basis before you can trade. Your trader identity may be shown on your listings. You are responsible for your own VAT, consumer-law and product-safety obligations, including the right of withdrawal (Section 7) and the legal guarantee (Section 8).
Professional sellers are also bound by the separate Professional Seller Agreement (commission, payouts, tax reporting and Platform-to-Business rights), which prevails over these Terms where they conflict for professional sellers.
Tax reporting (DAC7). As an EU platform, Anew is required to collect certain seller information and report qualifying sellers' identity and income to the tax authorities under Council Directive (EU) 2021/514 ("DAC7"). Sellers below the casual-activity threshold (fewer than 30 sales and under €2,000 total in a calendar year) are generally not reported, but we may still need to collect the information to make that assessment.
13. Ranking, boosts and curation
Search results are ordered mainly by relevance to your query and filters, recency and distance. Boosted listings are paid promotions and are shown accordingly; curated picks are selected editorially. Paid placement is a main ranking parameter and is disclosed here in line with EU platform-transparency rules.
14. Liability
Because Anew is an intermediary, we are not responsible for the quality, safety, legality or accuracy of items listed by users, nor for users' performance of their contracts, beyond the buyer-protection service we expressly provide. Nothing in these Terms excludes liability that cannot be excluded by law, including your mandatory consumer rights. Subject to that, our aggregate liability is limited to [the fees you paid to Anew in the 12 months before the claim / a stated cap].
15. Suspension and termination
You may close your account at any time. We may suspend or terminate access if you breach these Terms, create risk for others, or where required by law, with notice and a statement of reasons where the DSA requires it. Some obligations (e.g. completing open transactions, statutory record-keeping) survive termination.
16. Governing law and dispute resolution
These Terms are governed by the law of [country of the operating entity — e.g. Belgium], without depriving consumers of the mandatory protections of their country of residence. Disputes fall to the competent courts of [the operator's seat], subject to any consumer's right to sue or be sued in their own country.
Alternative dispute resolution. If we cannot resolve a complaint directly ([support@shopanew.eu]), consumers may turn to a competent out-of-court dispute-resolution body in their country, such as [the Belgian Consumer Mediation Service — Service de médiation pour le consommateur / Consumentenombudsdienst]. Note: the EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and no longer exists; we therefore point you to national ADR bodies instead.
17. Changes to these terms
We may change these Terms. For material changes we will give reasonable prior notice (and, for professional sellers, the notice period required by the EU Platform-to-Business Regulation). Continuing to use Anew after changes take effect means you accept them.
